Terms of Service

1. Agreement to Terms

By accessing or using SharksAPI.AI (https://sharksapi.ai), operated by Marketing Sharks OÜ (Estonia), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Description of Service

SharksAPI.AI is an AI-powered business automation platform that provides:

• MarketingBot: Marketing analytics, social media management, SEO tools, ad campaign tracking
• SalesBot: CRM integration, email campaigns, lead generation, web crawling
• OpsAgent: Productivity tools, calendar, email, file management, project management
• ManagementBot: Business intelligence, KPI tracking, financial overview, team management
• SupportAgent: 24/7 customer support automation, ticketing, knowledge base
• MCP Server: Model Context Protocol integration for Claude AI
• API Access: REST API and Custom GPT integrations

3. Account Registration

• You must provide accurate and complete registration information
• You are responsible for maintaining the security of your account credentials
• You must be at least 16 years old to use the service
• One person or entity per account; accounts are non-transferable
• You are responsible for all activity under your account

4. Acceptable Use

4.1 You agree NOT to:

• Use the service for any illegal purpose or in violation of applicable laws
• Send unsolicited spam or bulk emails that violate anti-spam laws (CAN-SPAM, GDPR)
• Attempt to gain unauthorized access to other users' accounts or data
• Reverse engineer, decompile, or disassemble the service
• Use the service to store or transmit malware or malicious code
• Exceed reasonable API rate limits or abuse automated access
• Share API tokens, MCP credentials, or account access with unauthorized parties
• Scrape or crawl websites in violation of their robots.txt or terms of service

4.2 Email Campaigns

• You must comply with all applicable email marketing laws (GDPR, CAN-SPAM, ePrivacy)
• Recipients must have given valid consent to receive emails
• Every email must include an unsubscribe mechanism
• You are solely responsible for the content and legality of your email campaigns

5. Third-Party Integrations

• SharksAPI.AI connects to 75+ third-party services on your behalf
• You must have valid accounts and appropriate permissions for each connected service
• You are responsible for complying with each third-party service's terms of service
• We are not responsible for changes, outages, or data loss caused by third-party services
• OAuth tokens and API keys are stored encrypted and can be revoked at any time

6. AI and Automated Processing

• AI-generated content, insights, and recommendations are provided "as-is" without guarantees of accuracy
• You are responsible for reviewing and validating AI-generated content before publishing or acting on it
• AI processing may involve sending your data to third-party providers (OpenAI, Anthropic, Google)
• Automated actions (email sending, social posting) are executed based on your explicit configuration
• We are not liable for damages resulting from AI-generated content or automated actions

7. MCP and API Access

• MCP (Model Context Protocol) server access is provided for authorized AI assistant integrations
• API tokens and MCP credentials must be kept confidential
• Excessive or abusive API usage may result in rate limiting or account suspension
• We reserve the right to modify API endpoints, tools, and capabilities
• API access is bound to project scope and cannot cross project boundaries

8. Intellectual Property

• SharksAPI.AI platform, design, and code are owned by Marketing Sharks OÜ
• Your data remains your property; we claim no ownership of your content
• AI-generated content created through our service is your property to use
• You grant us a limited license to process your data solely for providing the service

9. Limitation of Liability

To the maximum extent permitted by law:

• The service is provided "AS IS" and "AS AVAILABLE" without warranties
• We do not guarantee uninterrupted, secure, or error-free service
• We are not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid for the service in the preceding 12 months
• We are not liable for data loss, business interruption, or losses caused by third-party service failures

10. Termination

• You may terminate your account at any time from your profile settings
• We may suspend or terminate accounts that violate these terms
• Upon termination, your data will be deleted within 30 days
• Provisions regarding liability, intellectual property, and dispute resolution survive termination

11. Governing Law

These Terms are governed by the laws of the Republic of Estonia and the European Union. Any disputes shall be resolved in the courts of Tallinn, Estonia.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or dashboard notification at least 14 days before taking effect. Continued use after changes constitutes acceptance.
